Terms & Conditions
- Proposal valid for 30 days from date of issue.
- Pricing assumes normal soil conditions and unobstructed site access during standard business hours.
- Permits, engineering, surveying, and testing by Owner unless explicitly itemized.
- Payment terms: 20% mobilization deposit, monthly progress billing, balance net 30 from substantial completion.
- Retainage capped at 5% and released upon project closeout documentation.
- Change orders required in writing prior to performance of additional work.
Legal Protection & Exclusions
- Differing site conditions, contaminated soils, dewatering beyond ordinary pumping, and rock excavation are excluded and billed by change order.
- Contractor maintains General Liability ($2M), Auto, and Workers' Compensation coverage. Owner named as additional insured upon request.
- Force majeure events (severe weather, labor disputes, supply-chain disruption, governmental action) extend the schedule day-for-day without penalty.
- Contractor's aggregate liability is limited to the contract sum. Consequential, incidental, lost-profit, and delay damages are mutually waived.
- Mechanic's lien rights are reserved per state statute. Disputes resolved by binding arbitration in Contractor's home county.
